Applicable normative

The second section of Article 22 of Law 34/2002 of 11 July on Services of the Information Society and Electronic Commerce (hereafter referred to as the ‘LSSI-CE’) establishes the following:

*1. Service providers may use storage and retrieval devices for data on end users’ terminal equipment, provided that they have given their consent after being provided with clear and complete information about their use, particularly regarding the purposes of data processing, in accordance with the provisions of Organic Law 15/1999 of 13 December on the Protection of Personal Data.

When it is technically possible and effective, the recipient’s consent to accept the processing of data can be facilitated by using the appropriate browser or application parameters, provided that the recipient must proceed to configure them during installation or update by expressly acting to this effect.

The foregoing shall not prevent the possible storage or access of a technical nature, solely for the purpose of transmitting a communication via an electronic communications network, or to the extent that it is strictly necessary for the provision of an information society service expressly requested by the recipient.

According to the ‘Guide on the use of cookies’, published by the Spanish Data Protection Agency (hereafter referred to as the AEPD) in 2013, the LSSI-CE is applicable to any type of file or device that is downloaded to a user’s terminal equipment with the aim of storing data that can be updated and recovered by the entity responsible for its installation. The cookie is one of these widely used devices, so we will refer to these devices generically as cookies from now on.

The obligations established in Article 22.2 of the LSSI-CE do not apply to cookies used for any of the following purposes:

Types of cookies according to their purpose

A cookie is a file that is downloaded to your computer when you access certain websites. Cookies enable a website, amongst other things, to store and retrieve information about a user’s or their computer’s browsing habits and, depending on the information they contain and the way in which you use your computer, they may be used to recognise the user.

As set out in the AEPD’s “Guide on the use of cookies”, depending on the purpose for which the data obtained through cookies is processed, we can distinguish between:

  • Technical cookies: These are cookies that enable the user to navigate a website, platform or application and to use the various options or services available on it, such as managing traffic and data communication, identifying the session, accessing restricted-access areas, remember the items included in an order, complete the purchase process for an order, submit a registration or participation request for an event, use security features whilst browsing, store content for the streaming of videos or audio, or share content via social media.
  • Personalisation cookies: These are cookies that allow the user to access the service with certain general features pre-set according to a series of criteria on the user’s device, such as the language, the type of browser used to access the service, the regional settings from which the service is accessed, etc.
  • Analytics cookies: These are cookies that enable the data controller to monitor and analyse the behaviour of users of the websites to which they are linked. The information collected through this type of cookie is used to measure the activity on websites, applications or platforms and to create browsing profiles of users of those sites, applications and platforms, with the aim of making improvements based on the analysis of how users utilise the service.
  • Advertising cookies: These are cookies that enable the most effective possible management of any advertising space that the publisher may have included on a website, app or platform from which the requested service is provided, based on criteria such as the content published or the frequency with which the adverts are displayed.
  • Behavioural advertising cookies: These are cookies that enable the most effective possible management of any advertising space that the publisher may have included on a website, app or platform through which the requested service is provided. These cookies store information on user behaviour obtained through the continuous monitoring of their browsing habits, which enables a specific profile to be developed in order to display advertising tailored to that profile.

Principle of information

In accordance with the provisions of Article 5 of Organic Law 15/1999 of 13 December on the Protection of Personal Data (hereinafter ‘LOPD’), we hereby inform you explicitly, precisely and unequivocally that the information obtained through the cookies installed on your computer will be used for statistical purposes.

The recipient of the information obtained through the cookies installed on your computer is AICRUMIT S.L.

The principle of consent

Consent to the use of cookies shall be deemed to have been given by ticking the box indicating acceptance of the “Cookie Policy” provided for this purpose on our website.

In cases where the user does not expressly state whether or not they accept the installation of cookies, but continues to use the website or the application, it will be understood that they have given their consent, and our organisation will expressly inform them of the possibility of blocking or deleting the cookies installed on their device by adjusting the settings of the browser installed on their computer.

The optional nature of the use of cookies

Whilst you are free to choose whether or not to accept the installation of cookies on your computer, refusing to do so may result in the website’s functionality being limited or unavailable, which would make it impossible for our organisation to provide services via the website.
